1. Introduction

Welcome to Ghostfeed ("we", "our", "us")!

These Terms of Service ("Terms", "Terms of Service") govern your use of our website located at https://ghostfeed.ai (together or individually "Service") operated by Meet Shukla under the name Ghostfeed in Ontario, Canada.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.

Your agreement with us includes these Terms and our Privacy Policy ("Agreements"). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

2. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at [email protected].

3. Purchases

If you wish to purchase any product or service made available through Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including but not limited to, your credit or debit card number, the expiration date of your card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

All sales are final and no refunds will be issued, except in exceptional circumstances which will be reviewed on a case-by-case basis at Ghostfeed's sole discretion. Any refund requests must be submitted in writing to [email protected] with a detailed explanation of the exceptional circumstances.

4. Use License

This section covers Ghostfeed's website materials and software. It does not limit your rights in content you upload or generate through the Service. Permission is granted to temporarily download one copy of the website materials for personal, non-commercial transitory viewing only. This is a license, not a transfer of title. Under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
• attempt to decompile or reverse engineer any software contained on Ghostfeed's website;
• remove any copyright or other proprietary notations from the materials; or
• transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Ghostfeed at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

5. Disclaimer

The materials on Ghostfeed's website are provided on an 'as is' basis. Ghostfeed makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Ghostfeed does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

6. Limitations

In no event shall Ghostfeed or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Ghostfeed's website, even if Ghostfeed or a Ghostfeed authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Accuracy of Materials

The materials appearing on Ghostfeed's website could include technical, typographical, or photographic errors. Ghostfeed does not warrant that any of the materials on its website are accurate, complete or current. Ghostfeed may make changes to the materials contained on its website at any time without notice. However Ghostfeed does not make any commitment to update the materials.

8. Links

Ghostfeed has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Ghostfeed of the site. Use of any such linked website is at the user's own risk.

9. Modifications

Ghostfeed may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

10. Content Generation and Usage

You retain any rights you have in the prompts, photos, videos, audio, and other source materials you upload ("Inputs"). Ghostfeed does not claim ownership of the images, videos, audio, or other content generated for you through the Service ("Outputs"). Ghostfeed does not restrict your commercial use of Outputs. You may use them in advertising, client work, and paid third-party applications, and may transfer or license your rights in them to others. These use rights continue after you cancel a subscription or delete your account. You remain responsible for having the rights and permissions needed for your Inputs and for your use of Outputs. Outputs may be similar to content generated for other users, and Ghostfeed does not guarantee that an Output is unique, non-infringing, or eligible for intellectual-property protection. Inputs and Outputs are together called your "Assets" below.

You grant Ghostfeed a non-exclusive license to host, process, transmit, and display Inputs and Outputs as needed to provide, secure, and support the Service. This includes sending the media needed for a requested feature to third-party model providers. Unless you turn off Allow training on my assets in Training settings in your account menu, you also grant Ghostfeed a non-exclusive license to use your Assets to train and improve its own AI models. Turning the setting off stops Ghostfeed from using your Assets to train. The setting does not control how third-party model providers process or train on your Assets under their own terms. Our Privacy Policy explains provider processing.

By using our AI-powered content generation tools, you acknowledge and agree that:

• You are responsible for ensuring that generated content complies with applicable laws and platform terms of service
• You have the rights to any source materials you upload for content generation

Adult or sexually explicit content is not allowed on the Service, including content depicting fictional adult characters. You may not use the Service to create or share sexual content involving minors, non-consensual intimate imagery, or any content that violates another person's rights or applicable law.

11. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to any rights you have under applicable law, the courts of Ontario have jurisdiction over disputes arising from these Terms.
